1. The Service
Job Ping monitors publicly available employer career pages and notifies subscribers, via push notification, of job postings matching filters (“Monitors”) that the user configures. Job Ping is an alerting and discovery tool. We do not process job applications on your behalf, guarantee that any employer will consider your application, or guarantee the accuracy, availability, or timeliness of any job listing.
Job Ping is not affiliated with, endorsed by, or sponsored by any employer or company referenced in the App. Company names, logos, and job listing content belong to their respective owners and are used solely for identification purposes.
2. Eligibility and Accounts
- You must be at least 16 years old to use the App. The App is not directed at children, and we do not knowingly permit use by anyone under 16.
- Accounts are created and authenticated through Sign in with Apple. We do not require or collect your name or email address to create an account.
- You are responsible for maintaining the security of the device and Apple ID used to access the App.
3. Subscriptions
3.1 Auto-Renewing Subscription
Job Ping offers an auto-renewing subscription (the “Subscription”) that unlocks premium features of the App, as described on the in-app subscription screen at the time of purchase. The title, duration, and price of the Subscription (and price per unit, where applicable) are disclosed on that screen and in App Store Connect metadata before you purchase.
Unless you cancel at least 24 hours before the end of the current period, your Subscription automatically renews for an additional period of the same length, at the then-current price, and your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
3.2 Free Trial
Job Ping may offer a free trial period that unlocks App features without an App Store subscription charge. Free trial eligibility, length, and terms are as displayed in the App at the time of the offer and are subject to change.
When a free trial ends, your access to paid features ends unless you purchase the Subscription. Starting a free trial does not by itself authorize Apple to charge your Apple ID. If you later purchase the Subscription through the App Store, billing, auto-renewal, cancellation, and refunds work as described in Sections 3.1 and 3.3.
3.3 Billing, Cancellation, and Refunds
All payments are processed exclusively by Apple through the App Store’s in-app purchase system. Job Ping does not directly collect, process, or store your payment card information.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions are managed entirely through your Apple ID account settings. You can review, modify, or cancel your Subscription at any time in Settings > [Your Name] > Subscriptions on your device, or via the App Store.
- Deleting the App does not cancel your Subscription. You must cancel through your Apple ID account settings to stop future charges.
- All refund requests are handled by Apple in accordance with Apple’s Media Services Terms and Conditions and applicable App Store refund policies. Job Ping has no ability to issue refunds directly and cannot override Apple’s refund decisions.
3.4 Changes to Subscription Pricing or Features
We may change Subscription pricing or included features from time to time. Any price change will be presented to you in accordance with Apple’s requirements before it takes effect for your Subscription, and you will have the opportunity to review and accept the new price before it is charged.
4. Account Data and Deletion
Our data practices are described in our Privacy Policy, which is incorporated into these Terms by reference. In summary: the App is designed to operate on a de-identified basis, and you may permanently delete your account and associated data at any time using the in-app deletion feature. Because your account is tied to an anonymous identifier rather than an email address, deleting your account is irreversible — we have no way to identify or restore your account or data afterward, and no email-based recovery is available.
We retain a purchase record tied to your anonymized identifier as required for financial reporting and tax purposes, even after an account deletion request, as described in our Privacy Policy.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose, or to violate any employer’s terms of use for their own career site;
- Attempt to reverse engineer, scrape, or extract data from the App itself (as distinct from the underlying career pages we lawfully monitor);
- Interfere with or disrupt the App’s infrastructure or attempt to gain unauthorized access to any Job Ping system;
- Use automated means to create Monitors, Requests, or accounts at a volume inconsistent with ordinary individual use;
- Misrepresent your identity or affiliation in any Request or Collection you submit.
6. Community Collections
The App lets eligible users publish “Collections” — shared Monitor configurations (including a name and description) that other users may browse and use as a starting point. By publishing a Collection, you grant Job Ping a non-exclusive, worldwide, royalty-free license to host, display, distribute, and allow other users to use and adapt that Collection in connection with the App. You represent that you have the right to publish the Collection content you provide and that it does not infringe any third party’s rights.
7. Intellectual Property
The App, including its software, design, and Job Ping’s own content (excluding third-party job listing data and employer trademarks), is owned by Job Ping App LLC and protected by intellectual property laws. Subject to your compliance with these Terms and Apple’s standard EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, for your personal, non-commercial use.
8. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT JOB PING WILL DETECT ANY PARTICULAR JOB POSTING, THAT NOTIFICATIONS WILL BE TIMELY, OR THAT ANY LISTING INFORMATION IS ACCURATE OR CURRENT. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING JOB LISTING DETAILS DIRECTLY WITH THE EMPLOYER BEFORE APPLYING OR RELYING ON ANY INFORMATION IN THE APP.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOB PING APP LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, OPPORTUNITIES, OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN SUBSCRIPTION FEES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS ($50).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Job Ping App LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the App, your violation of these Terms, or your violation of any third party’s rights, including any employer’s terms of use.
11. Dispute Resolution and Arbitration
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
You and Job Ping agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App (“Dispute”) will be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring an individual action in small claims court.
- The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- The arbitration will be conducted in Dallas, Texas, or another mutually agreed location, or by telephone/video conference at the option of the party seeking arbitration.
- YOU AND JOB PING EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION. Disputes must be brought in an individual capacity only.
- If the class action waiver is found unenforceable as to a particular Dispute, then that Dispute (and only that Dispute) will proceed in court rather than in arbitration.
You may opt out of this arbitration provision within 30 days of first accepting these Terms by emailing support@jobping.app with the subject line “Arbitration Opt-Out” and your account identifier. Opting out does not affect the validity of the rest of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles, except to the extent governed by the Federal Arbitration Act with respect to Section 11.
13. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if required to do so by law. We may also modify, suspend, or discontinue the App (or any part of it) with or without notice. Termination does not entitle you to a refund; Subscription cancellations and refunds are handled per Section 3.3.
Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and miscellaneous) will survive.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the App or by updating the “Effective Date” above. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
15. Miscellaneous
- Entire Agreement: These Terms, together with our Privacy Policy and Apple’s standard EULA, constitute the entire agreement between you and Job Ping regarding the App.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
- No Waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment: You may not assign these Terms. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Third-Party Beneficiary: You acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you to the extent related to Apple’s role under Apple’s standard EULA and the App Store.
